General business conditions

Es gibt anscheinend Rechtsanwälte die ihren Lebensunterhalt damit bestreiten, dass sie arglose Bürger abmahnen die in ihren Internetauftritten unwissentlich einen kleinen Formfehler versteckt haben. Um einer solchen kostenintensiven “Abmahnung” zu entgehen ist es anscheinend nötig diese AGBs mit zu veröffentlichen.

Ich hoffe und wünsche mir dass diese Seite wirklich nur für so einen spitzfindigen Winkeladvokaten eingefügt ist.

Diese Geschäftsbedingungen und ortsüblichen Provisionssätze entsprechen den Gepflogenheiten der Makler in Ungarn

Unsere Tätigkeit erfolgt im Rahmen der §§ 652 ff des BGB, der allgemein kaufmännischen Grundsätze und Gebräuche unter Einhaltung der Standesregeln der Immobilienmakler. Unsere Tätigkeit ist auf den Nachweis oder/und die Vermittlung von Verträgen gerichtet.

- Maklervertrag
Mit Inanspruchnahme der Maklertätigkeit bzw. Aufnahme von Verhandlungen mit dem Verkäufer aufgrund unseres Angebots kommt der Maklervertrag mit dem Kaufinteressenten zu den nachfolgenden Bestimmungen zustande.

- Angebot
Das Angebot des Maklers versteht sich freibleibend und unverbindlich und ist nur für den Adressaten bestimmt. Jede Weitergabe der Information an Dritte ist untersagt. Ist dem Auftraggeber unser Angebot bereits von anderer Seite bekannt, so ist er verpflichtet, uns binnen 8 Tagen schriftlich mitzuteilen und nachzuweisen, woher er die Kenntnis erlangt hat. Geschieht dies nicht, so erkennt der Empfänger unseren Nachweis an.

- Doppeltätigkeit 
Der Makler ist berechtigt, für beide Seiten des beabsichtigten Vertrages provisionspflichtig tätig zu werden.

- Provision 
Unsere Maklerprovision ist verdient, sofern durch unsere Nachweis- oder Vermittlungstätigkeit ein Vertrag zustande kommt.

Bei einem Verkaufspreis bis 45000,00-€ beträgt die Provision 1800,00 €. 

Bei einem Verkaufspreis über 45000,00-€ beträgt die Provision 4% vom Verkaufspreis.

Die Provision ist vom Verkäufer/Käufer bei Vertragsunterzeichnung zu entrichten. 

Die Provision ist für den Nachweis oder die Vermittlung zu zahlen. Sie ist fällig mit der Tätigung des Vertrages. Mitursächlichkeit genügt. Sie ist zahlbar 8 Tage nach Rechnungslegung.

Der Provisionsanspruch bleibt auch bestehen, wenn der abgeschlossene Vertrag durch Eintritt einer auflösenden Bedingung erlischt oder aufgrund eines Rücktrittsvorbehaltes oder aus sonstigem Grund gegenstandslos oder nicht erfüllt wird.

Der Provisionsanspruch entsteht auch dann, wenn der Auftraggeber den erhaltenen Nachweis an einen Dritten weitergibt und dieser den Kaufvertrag abschließt.

- Gleichwertigkeit 
Dem Abschluss eines Kaufvertrages entsprechen der Erwerb des Objektes im Wege der Zwangsversteigerung, die Übertragung von realen oder ideellen Anteilen sowie der Erwerb eines anderen, vergleichbaren Objektes des Verkäufers. Kommen andere Verträge oder Vereinbarungen in einer wie auch immer gearteten Form zustande als im Angebot genannt, so wird dafür unsere Provision fällig.

- Beurkundung 
Der Makler hat Anspruch auf Teilnahme am Beurkundungstermin und auf eine Ausfertigung der Kaufurkunde.

- Haftung 
Die umseitige Objektbeschreibung wurde aufgrund der Angaben des Verkäufers erstellt. Der Makler hat diese Informationen nicht überprüft und kann deshalb für deren Richtigkeit keine Haftung übernehmen.

 
Der Makler hat Anspruch auf Teilnahme am Beurkundungstermin und auf eine Ausfertigung der Kaufurkunde.

- Haftung 
Die umseitige Objektbeschreibung wurde aufgrund der Angaben des Verkäufers erstellt. Der Makler hat diese Informationen nicht überprüft und kann deshalb für deren Richtigkeit keine Haftung übernehmen.

 

- Schlußbestimmungen 
Unsere Angebote sind freibleibend, Zwischenverkauf und Vermietung bzw. Verpachtung sind vorbehalten. Sollten einzelne Bestimmungen dieses Vertrages nichtig sein, wird dadurch die Wirksamkeit der verbleibenden Vorschriften nicht berührt. Durch Auftragserteilung und / oder Nutzung der Internetpräsenz werden die AGBs anerkannt.

Erfüllungsort und Gerichtsstand ist der Sitz der Balaton Haus und Garten KFT.

Consequences of Revocation

In the case of an effective revocation, the services received by both sides must be returned and any benefits received (e.g. interest) reimbursed. If it is not possible to return the service provided in part or in full or if it can only be returned in a deteriorated condition, then it is possible that you will have to provide compensation for loss of value. This could mean that you will have to fulfill the contractual payment obligations for the time period leading up to the revocation. Obligations for reimbursing payments must be fulfilled within 30 days. The period begins for you upon dispatch of the notice of revocation and for us upon receipt of the same.

Special note:

Your right of revocation will expire prematurely if the contract has been executed in full by both parties at your explicit request prior to your exercising your right of revocation.
